Preamble

These Terms of Service (hereinafter "Terms") govern all contractual relationships between 26 Caribbean SRL, a company incorporated under Dominican law, Dominican Republic (hereinafter "the Publisher" or "FlashYourListing"), and any individual or legal entity accessing the FlashYourListing service (hereinafter "the User").

FlashYourListing is an online service accessible at flashyourlisting.com that enables real estate professionals and sellers wishing to market a property to generate, from submitted data and uploaded photos, a set of AI-powered marketing and commercial content designed to promote and sell real estate.

Accessing the Service and using its features constitutes full and unreserved acceptance of these Terms. Any use of the Service implies unconditional acceptance of these Terms.

1Definitions

For the purposes of these Terms, the following terms have the meanings set out below:

  • "Service": refers to the FlashYourListing platform in its entirety, including the website, data entry interface, AI content generation engine, produced deliverables, associated storage, and all ancillary features.
  • "Flash": refers to a content generation session for a specific property, initiated by the User, producing a set of deliverables as defined by the chosen plan.
  • "Free Flash": refers to the free trial session, available once per phone number, producing a partial set of textual deliverables in English only, with watermark, accessible for 48 hours, and excluding the PDF brochure and formatted social-media images.
  • "Paid Flash": refers to the full session purchased at the applicable price, producing all textual deliverables in English and Spanish, the full set of formatted social-media images, and the personalised PDF brochure, without watermark, with permanent access to the archive.
  • "Deliverables": refers to all content generated by the Service following a Flash, including in particular marketing texts, social media posts, scripts, emails, financial summary, formatted social-media images, PDF brochure, and agent pitch kit.
  • "Flash Data": refers to all information entered by the User via the submission form (property type, city, sector, price, photos, financial data, etc.) used for content generation.
  • "AI": refers to the third-party artificial intelligence models used by the Service to analyse data and produce Deliverables.
  • "Account": refers to the User's personal space, created at the moment of the Unlock click (or at the direct "Create a Flash" entry point), providing access to the Flash history, the personalised PDF brochure, and the personal data required to render the brochure (agent name, photo, agency logo, WhatsApp number).
  • "Personal data of the Account": refers to: email address, password (stored as a hash), first name, last name, main phone / WhatsApp number, secondary phone / WhatsApp number (optional), personal photo (optional), agency logo (optional).

2Access to the Service and Registration

2.1 Access conditions

Access to the Service is open to any individual or legal entity with a valid mobile phone number. The User warrants that the information provided at registration is accurate and up to date.

The Service is available exclusively in the Dominican Republic at launch. The Publisher reserves the right to extend the geographic availability of the Service to other markets without prior notice.

2.2 Two entry points

The Service offers two entry points to generate a Flash:

Free entry point: the User submits the property form and uploads the photos, then verifies their phone number by SMS code. The Service produces a Free Flash, with the limits set out in Article 2.4. Upon clicking the "Unlock" button, the User is invited to either log into an existing Account or create a new one (Article 2.3), then to proceed to payment (Article 4) to obtain the full Paid Flash.

Direct entry point: the User clicks "Create a Flash" from the home page or from the navigation. The Service first invites the User to either log into an existing Account or create a new one (Article 2.3), then opens the property form and proceeds directly to payment (Article 4). No Free Flash is delivered through this entry point.

2.3 Account creation

An Account is created at the moment of the Unlock click (Free entry point) or at the moment of the direct entry ("Create a Flash" entry point), prior to payment. Account creation requires the User to provide the following data:

  • Email address — required, will serve as the unique identifier of the Account.
  • Password — required, minimum 8 characters including at least one digit. The password is stored solely as a cryptographic hash; the Publisher does not have access to the password in clear text.
  • First name and last name — required, will appear on the personalised PDF brochure.
  • Main phone / WhatsApp number — required, will appear on the WhatsApp button of the personalised PDF brochure.
  • Secondary phone / WhatsApp number — optional, used solely for identity verification and never displayed on the brochure.
  • Personal photo — optional, will appear on the contact page of the personalised PDF brochure if provided.
  • Agency logo — optional, will appear on the cover of the personalised PDF brochure if provided.

The personal photo and the agency logo are uploaded via the Account area. The User may add them at Account creation or at any later time from the Account area. The Account area also allows the User to replace them as often as required.

Immutability of identifier and identity fields

Once the Account is created, the email address, the first name and the last name cannot be modified by the User. These fields constitute the Account identity and the basis of the personalised PDF brochure. Should the User wish to change any of these fields, they must create a new Account, and the phone number will be re-verified by SMS code to confirm the identity of the User. This re-verification also serves to prevent the same User from obtaining a second Free Flash through Account renewal. All other Account fields (password, main phone, secondary phone, personal photo, agency logo) remain modifiable at any time from the Account area.

2.4 Free Flash — specific conditions

One Free Flash is granted per phone number. The Service performs an identity check against all known phone numbers in its database — including phone numbers previously used for a Free Flash and the main and secondary phone numbers of all existing Accounts — to ensure that each User benefits from a single Free Flash. The Free Flash produces a partial set of Deliverables with the following characteristics:

  • Textual content in English language only — no Spanish version.
  • Watermark applied on all visual displays of the deliverables.
  • Access to the results limited to 48 hours from generation.
  • No formatted social-media images — these images are produced exclusively for Paid Flashes.
  • No personalised PDF brochure — the brochure is produced exclusively for Paid Flashes, as it requires the personal data of the Account (Article 1) which are not collected at the Free Flash stage.
  • No downloadable content.
  • No email sent — in-app access only, no Account associated with a Free Flash.
  • No regeneration possible at the Free Flash stage.

Upon expiry of the 48-hour period, the Free Flash content becomes inaccessible. The Publisher has no obligation to retain Free Flash content after this period.

3Description of the Service and Deliverables

3.1 General operation

The User submits a form containing property data (type, location, price, financial data where relevant, amenities, views, surroundings) along with between 5 and 10 photographs of the property. The Service processes this data through an AI pipeline to produce Deliverables within a target timeframe of approximately 1 minute, depends on the WIFI or mobile service provider.

The Service generates the Deliverables on the strict basis of the form data and the photographs uploaded by the User. The completeness, accuracy and quality of the form data, and the quality of the photographs, directly determine the quality of the Deliverables produced. The User is invited to carefully review the form and the photographs before clicking the "Generate" button.

Irreversibility of Flash generation

Once the User validates the form and launches the Flash by clicking "Generate", the generation of the Deliverables is launched immediately and cannot be cancelled, modified or refunded. Any error, omission, or low-quality input that becomes apparent only after this moment cannot be corrected before generation. The User is therefore strongly advised to verify the form data and the photographs in detail before clicking "Generate". This rule applies to the Free Flash and to the Paid Flash alike.

3.2 Paid Flash deliverables

A Paid Flash produces, based on the data entered, up to 20 sales tools organised in four categories:

  • Marketing texts (English + Spanish): property description, Instagram post, Facebook post, Facebook Ads (3 variants), LinkedIn post, TikTok hook + caption, X/Twitter posts, SEO package, WhatsApp first contact, WhatsApp sales message, prospect email, video visit script.
  • Formatted social-media images: 10 formatted images (5 versions with a text hook + 5 photo-only versions), produced in the current dimensions of the targeted social platforms.
  • Financial summary (English + Spanish): investment dashboard with calculated metrics (gross yield, monthly cashflow, payback period, Confotur impact when applicable), narrative summary adapted to the detected buyer segment.
  • Sales tools (English + Spanish): sales arguments by buyer profile, buyer objections, property visit guide, seller pitch kit, personalised PDF brochure in a single bilingual document.

The exact content of the deliverables depends on the data entered by the User. Certain deliverables (in particular the financial summary metrics) are only produced if the corresponding financial data has been provided. The personalised PDF brochure displays the User's first name, last name, personal photo (if provided), agency logo (if provided) and main WhatsApp number, all collected at Account creation (Article 2.3).

The Publisher reserves the right to modify the content and composition of the deliverables. In the event of a substantial reduction in the number of tools available, the Publisher undertakes to notify Account-holding Users with reasonable prior notice.

3.3 Languages

The Paid Flash produces all textual deliverables in English AND Spanish (Latin American Spanish) via two distinct native passes. Formatted social media images are generated in English only, as their format is universal. The Free Flash produces textual deliverables in English only — the Spanish version is delivered solely upon transition to a Paid Flash.

3.4 Editability of Deliverables

All textual Deliverables produced by the Service (descriptions, social-media posts, emails, scripts, sales arguments, visit guides, pitch kits) are editable by the User from the results interface. The User may freely modify, complete, shorten, extend or rephrase any textual Deliverable to add a personal touch before sending it to a third party. The personalised PDF brochure, however, is generated in its final form and is not editable in the platform — the User may change or download it and modify it in a third-party tool of their choice.

4Pricing, Payment and Invoicing

4.1 Price

The price of a Paid Flash is displayed on the Service at the time of purchase. This price is denominated in US dollars (USD) and includes all deliverables described in Article 3.2. The Publisher reserves the right to modify the price at any time; the applicable price is the one displayed at the time of the transaction.

4.2 Payment methods

Payment is made exclusively via PayPal, a secure third-party payment platform. The Publisher has no access to any of the User's banking data. The transaction is subject to PayPal's terms and conditions, which the User acknowledges having read. Transactions made via PayPal benefit from PayPal Buyer Protection in accordance with PayPal's applicable terms and conditions. Payment is due at the time of purchase. Access to the full Deliverables is unlocked immediately after payment confirmation by PayPal.

4.3 Payment confirmation

A payment confirmation email is automatically sent to the email address provided at Account creation. This email constitutes the transaction receipt and states the amount, the PayPal transaction ID, and the payment date.

4.4 Taxes

Prices shown are exclusive of applicable taxes. The User is solely responsible for the payment of any taxes, duties or charges applicable in their country of tax residence in connection with use of the Service.

5Access to Deliverables and Data Retention

5.1 Permanent access — Paid Flash

Paid Flash Deliverables are accessible from the User's Account without time limitation, subject to the provisions of Article 7 regarding Service continuity.

5.2 Version history

The Service retains the Flash accessible from the results interface.

5.3 Warning — Risk of Service interruption

FlashYourListing is an online service whose continuity cannot be absolutely guaranteed. The Publisher may be led to interrupt, modify, suspend or terminate the Service, temporarily or permanently, in particular in the event of a commercial decision, technical or regulatory constraint. Accordingly, all Users are strongly advised to download and save all their Deliverables locally immediately after generation. The Publisher accepts no liability for data loss resulting from a service interruption.

5.4 Backup recommendation

Users are strongly advised to:

  • Download the personalised PDF brochure after each Paid Flash.
  • Copy and locally save textual content (posts, emails, scripts, etc.) — preferably after applying any personalisation edits referred to in Article 3.5.
  • Download and retain the formatted social-media images.
  • Not rely exclusively on the platform as the sole storage location for their content.

The Publisher provides download features (PDF, JPG images, copy controls) specifically to enable this backup. The User is solely responsible for the retention of their data once downloaded.

5.5 Flash Data

Data entered by the User (form, photos) is retained in the Service database to enable access to Deliverables. This data may be deleted under the conditions set out in Article 10 (Personal Data Protection).

6Nature and Limitations of Generated Content

6.1 AI-generated content

All textual and visual Deliverables produced by FlashYourListing are automatically generated by artificial intelligence models from the data provided by the User. The Service applies extensive internal controls (factual filters, editorial filters, multilingual consistency checks, financial reconciliation) to maximise the quality and accuracy of the output. However, the technology underlying AI content generation cannot guarantee that every Deliverable is free from inaccuracies, omissions, awkward formulations or contextually imperfect statements. This content does not constitute professional advice of a legal, tax, financial, architectural or urban planning nature.

6.2 Quality of input — sole responsibility of the User

The quality and accuracy of the Deliverables depend directly on the data and the photographs provided by the User. The Service generates the Deliverables on the strict basis of the information available to it:

  • Form data: every field of the form (property type, surfaces, location, financial parameters, amenities, views, proximities, etc.) is used by the AI pipeline to construct the Deliverables. Inaccurate, incomplete or outdated form data will produce inaccurate, incomplete or outdated Deliverables.
  • Photographs: the photographs uploaded by the User serve both as the visual basis of the formatted social-media images and the personalised PDF brochure, and as a contextual input for the AI text generation. Low-resolution, poorly framed, dark, blurred or otherwise low-quality photographs will produce low-quality visual Deliverables and may also degrade the quality of the textual Deliverables that rely on photographic context.

The User is invited to verify the form data field by field and to review the photographs before launching the Flash. No correction to the form data or to the photographs is possible once the Flash has been launched (Article 3.1).

6.3 User-side validation — sole responsibility of the User

The User remains solely responsible for the validation, verification and accuracy of the content before any use, publication, distribution to clients or prospects, or use in the context of their activity. The textual Deliverables are editable from the results interface (Article 3.5): the User is free, and is encouraged, to adapt the generated texts, to add a personal touch, to correct any AI-introduced inaccuracy, and to ensure that the content matches their professional standards and their knowledge of the property before sending it to any third party.

FlashYourListing provides the version of content that the AI pipeline judges most appropriate for the property based on the data provided. Despite the extensive internal controls applied by the Service, AI-generated content may require adjustments by the User before publication. The Publisher cannot be held liable for any consequence arising from the use of inaccurate, unverified or unadjusted content.

In particular, it is the User's responsibility to verify and, where necessary, correct or supplement:

  • Property information (floor areas, number of rooms, amenities, status, price).
  • Location and geographical sector data.
  • Nearby points of interest and neighbourhood information generated by automatic enrichment.
  • Financial projections and indicators (yield, cashflow, payback period).
  • Information regarding the Confotur regime and tax benefits.
  • Any regulatory, legal or technical information relating to the property.
  • The tone, the style and the wording of any textual content, prior to publication on a third-party platform or distribution to a client or prospect.

6.4 Financial data — specific warning

The financial indicators generated by the Service (gross yield, monthly cashflow, payback period, Confotur savings) are illustrative estimates based on data entered by the User and simplified assumptions. These projections:

  • Do not constitute investment advice.
  • Do not guarantee future results.
  • Do not account for costs not entered (electricity, water, gas, internet, other operating expenses).

Users are encouraged to supplement and validate financial data with their own information and, where appropriate, to consult a qualified tax or financial adviser before communicating to a client. FlashYourListing provides an indicative calculation service and cannot guarantee the accuracy or completeness of the financial data generated. The User is further encouraged to consider applicable taxes and charges when presenting financial projections to a client, and where relevant, to invite the client to consult a qualified tax adviser.

6.5 Proximity data and geographic enrichment

Certain deliverables include information about the property's environment (neighbourhood, shops, services, character of the area) generated by automatic enrichment from online sources. This information is provided for commercial indicative purposes and may require verification by the User depending on the precise location of the property, its name and recent local developments.

6.6 Confotur regime

References to the Confotur tax exemption regime (Ley 158-01, Dominican Republic) are based on the legislation in force as interpreted at the time the Service was developed. The exemption period indicated is 15 years. Where the User indicates Confotur eligibility in the submission form, they warrant having verified the actual eligibility of the property with the competent authorities (CONFOTUR, DGII) prior to generating the Flash. The User must in any case verify such eligibility before communicating to a client, and is encouraged to consult a qualified tax adviser for any question relating to this regime. The legal and regulatory framework applicable to the Confotur regime may evolve at any time; it is the User's sole responsibility to ensure the information communicated to a client reflects the rules in force at the time of communication.

6.7 User's professional responsibility in the use of Deliverables

The User — whether acting as a real estate agent, agency, private seller or property developer — acknowledges being solely responsible for any content published, broadcast or transmitted to their clients, prospects or the general public, regardless of whether such content originates from the Service.

The generation of Deliverables by the Service does not transfer the User's responsibility to FlashYourListing. Each User, in their respective capacity, is solely responsible for verifying the accuracy of all information contained in the Deliverables — including prices, areas, financial projections, descriptions, location data, and any fiscal or legal statements — before any publication, advertising campaign, or transmission to a third party.

This obligation applies equally to: (i) real estate professionals and agencies using the Service on behalf of their clients; (ii) private individuals using the Service to market their own property; and (iii) property developers using the Service to promote projects under development or pre-sale.

FlashYourListing shall not be held liable for any consequence, direct or indirect, arising from the use of unverified or uncorrected Deliverables, including in the event of a dispute with an end client, misleading advertising, or any breach of the User's professional or civil obligations.

6.8 Generated images

Images produced by the Service are reformatted versions of photographs uploaded by the User, with the addition of a hook text automatically extracted from the generated content. The User is solely responsible for the right to use the photographs they upload to the platform. The User warrants that they are in full possession of the rights to use these images, in particular with regard to copyright. The User accordingly fully releases FlashYourListing from any claim or legal action brought by a third party claiming intellectual property rights over these images, and assumes sole and full liability for their use.

7Service Continuity and Availability

7.1 Availability

The Publisher undertakes to maintain the Service accessible as far as possible. However, the Publisher does not guarantee uninterrupted availability of the Service and reserves the right to carry out maintenance, updates or modifications without prior notice.

7.2 Temporary interruptions

The Service may be temporarily interrupted for technical, maintenance, security or force majeure reasons. The Publisher shall not be liable for damages resulting from such temporary interruptions.

7.3 Permanent discontinuation

The Publisher reserves the right to permanently discontinue the Service at any time. In the event of permanent discontinuation, the Publisher undertakes to notify Account-holding Users with reasonable prior notice, as far as possible. No refund shall be due for Flashes already generated and delivered. In the event of permanent discontinuation of the Service, data and Deliverables stored on the platform may become inaccessible. The Publisher expressly recommends that the User does not consider the platform as the sole and permanent storage location for their content.

7.4 Dependency on third-party services

The Service relies on third-party providers of artificial intelligence and infrastructure. The Publisher cannot be held liable for interruptions or degradations of the Service resulting from failures of these third-party providers.

8Intellectual Property

8.1 Ownership of the Service

The FlashYourListing Service, including its architecture, source code, interfaces, generation algorithms, prompts and segmentation logic, is the exclusive property of 26 Caribbean SRL. Any unauthorised reproduction, representation, extraction or use is strictly prohibited.

8.2 Ownership of Deliverables

Deliverables generated by the Service from data provided by the User are the property of the User, subject to payment of the applicable price. The User holds a full, non-exclusive licence to use these Deliverables in the exercise of their activity. The Publisher reserves the right to use anonymised examples of Deliverables for the purpose of improving the Service, without affecting the User's rights over their own content.

8.3 Uploaded data

The User warrants that they hold all necessary rights over the photographs, the agency logo, the personal photo and the data they upload to the platform. The User indemnifies the Publisher against any third-party claim relating to the content they submit to the Service.

9Acceptable Use Policy

The User undertakes to use the Service in the context of a lawful activity related to real estate. The following are prohibited in particular:

  • Submitting false or misleading data relating to a property.
  • Using Deliverables for fraudulent communications or contrary to applicable real estate regulations.
  • Attempting to circumvent authentication, payment or anti-double-Free-Flash verification systems.
  • Using automated means to access the Service at scale.
  • Reselling or sublicensing access to the Service to third parties.
  • Using the Service to generate content that infringes the rights of third parties.
  • Sharing Account credentials with third parties or operating multiple Accounts to circumvent the one-Free-Flash-per-User rule.

The Publisher reserves the right to suspend or terminate any User's access to the Service for non-compliance with these Terms, without prior notice or refund.

10Personal Data Protection

10.1 Data collected

In the context of using the Service, the Publisher collects the following data:

  • Mobile phone number (Free Flash identity verification).
  • Personal data of the Account (Article 1): email, password hash, first name, last name, main and secondary phone numbers, personal photo and agency logo where provided.
  • Property data submitted via the form.
  • Uploaded photographs.
  • Transaction data (PayPal ID, amount, date).
  • Navigation and usage data.

10.2 Purposes

This data is used for the following purposes: providing the Service, managing the User Account, rendering the personalised PDF brochure, sending transactional emails (payment confirmation, password reset, kit ready), preventing duplicate Free Flashes, improving the Service, and complying with legal obligations.

10.3 Retention

Personal data is retained for the duration necessary for the performance of the contract and compliance with applicable legal obligations. Flash-related data is retained for as long as the User holds an active Account. Free Flash content is retained for 48 hours after generation, then becomes inaccessible (Article 2.4).

10.4 Security of credentials

Account passwords are stored as cryptographic hashes (bcrypt or argon2) and are never stored or transmitted in clear text. The Publisher implements industry-standard measures including rate limiting on login attempts, single-use password reset tokens with a 30-minute expiration, and secure session cookies (httpOnly, secure, sameSite). The User is solely responsible for the confidentiality of their password and for the security of the device and network from which they access the Service.

10.5 User rights

In accordance with applicable personal data protection laws, the User has the right of access, rectification, deletion and portability of their data. These rights may be exercised by email to: support@flashyourlisting.com

10.6 Third-party providers

The Service uses third-party providers for its operation (artificial intelligence models, payment processor, SMS provider, hosting). These providers process certain data under their own privacy policies, to which the User is invited to refer.

11Limitation of Liability

11.1 General limitation

The Publisher shall not be liable for any indirect, consequential, incidental or punitive damage arising from the use of, or inability to use, the Service, including in particular data loss, loss of revenue, or loss of professional earnings.

11.2 Cap on liability

In cases where the Publisher's liability is established, it shall be limited to the amount actually paid by the User for the Flash in question.

11.3 Generated content

The Publisher does not warrant the accuracy, completeness or fitness for a particular purpose of the content generated by the Service. The User uses the Deliverables under their own professional responsibility and is expected to apply, in any event, the verification and editing steps set out in Articles 6.2 and 6.3.

11.4 Force majeure

The Publisher shall not be liable for any failure to meet its obligations resulting from a force majeure event, including in particular third-party provider outages, cyberattacks, natural disasters or unforeseeable regulatory changes.

12Right of Withdrawal and Refunds

Given the digital nature of the Service and the immediate delivery of Deliverables upon payment, the User expressly acknowledges that the right of withdrawal does not apply to Flashes already generated and delivered.

However, in the event of a proven technical failure of the Service preventing the delivery of Deliverables, the Publisher undertakes to offer either a regeneration of the Flash or a refund of the price paid. All requests must be sent to support@flashyourlisting.com within 7 calendar days of the transaction.

Dissatisfaction with the editorial or stylistic content of the Deliverables — which is, by nature, dependent on the form data and photographs provided by the User (Article 6.2) and subject to the User's editing capability (Article 3.5) — does not constitute grounds for a refund.

13Amendments to the Terms

The Publisher reserves the right to modify these Terms at any time. Amendments take effect upon their publication on the Site. In the event of a material change, the Publisher undertakes to notify Account-holding Users by email. Continued use of the Service after notification constitutes acceptance of the new terms.

14Governing Law and Jurisdiction

These Terms are governed by the law of the Dominican Republic. In the event of a dispute relating to the interpretation or performance of these Terms, the parties shall endeavour to find an amicable solution. Failing that, any dispute shall be subject to the exclusive jurisdiction of the competent courts of the Dominican Republic.
